Supreme Court’s Landmark Observation: Towards a More Balanced and Fair IC

In a landmark observation on July 8, the Supreme Court of India, led by Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra, expressed reservations about a petition that sought to mandate that sexual assault cases be handled exclusively by women public prosecutors, investigating officers, and medical examiners. This stance by the Supreme Court is not only commendable but also pivotal in breaking the long-standing myth that only women can effectively manage cases of sexual violence.

The Court’s remark that it is unreasonable to assume male officers would not fulfill their duties effectively in cases of gender violence is a breath of fresh air. This perspective is crucial, especially when many organizations insist on having all-women Internal Committees (IC) or women external members, fearing that including men might contravene the law. This belief often stems from a misinterpretation of the guidelines that indeed prioritize women’s safety but do not exclude the valuable contributions that men can make in such sensitive roles.

Inclusivity in handling sexual assault cases brings a more balanced and unbiased approach. The Supreme Court’s observation underscores the importance of a diverse and inclusive team, which can offer varied perspectives and enhance the credibility of the investigation process. This balanced composition is essential to ensure that the Internal Committee (IC) is seen as a neutral and fair institution.

It’s important to note that the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, already mandates a woman presiding officer and at least 50% women members on the IC. This requirement ensures that women’s voices are prominently represented. However, excluding men entirely from these roles can inadvertently create a biased perception and undermine the inclusivity that the law seeks to promote.

The Supreme Court’s stance helps in breaking stereotypes and fostering trust in the system. By affirming that male officers are equally capable of handling sexual violence cases, the Court paves the way for a more gender-balanced approach. This inclusivity can enhance the effectiveness of the IC, ensuring that all perspectives are considered, and justice is served impartially.

Moreover, having men in these roles can also promote a broader understanding and empathy towards issues of sexual harassment. It allows for the creation of a supportive environment where both men and women work together to address and prevent harassment, fostering a culture of mutual respect and collaboration.
